These Terms of Service ("Terms") govern your use of Thumbzit, an online AI-powered thumbnail generator designed to turn youtube video into thumbnails ("Service"), operated by El Ruedo Tech, a SASU company registered in France ("El Ruedo Tech", "we", "us", or "our"). By using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Service.

By accessing or using our Service, you confirm that you have read, understood, and agree to be bound by these Terms, including any future modifications. If you do not agree to these Terms, you may not use our Service.

We reserve the right to change or modify these Terms and/or the Service at any time. El Ruedo Tech reserves the unequivocal right to monitor & supervise the use of the Service to ensure compliance with these Terms of Use. El Ruedo Tech may, at its sole discretion, restrict access to the Service, take any necessary legal action against anyone who violates the Terms & cooperate with law enforcement authorities in prosecuting you if you violate the law.

Unless otherwise indicated, the Service & all content generated by the Service, including but not limited to texts, images, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork & computer code (collectively, the "Content"), are owned, controlled, or licensed by El Ruedo Tech. The Content is protected by copyright, trademark & other intellectual property rights & laws. Except as expressly provided in these Terms, no part of the Service & no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without El Ruedo Tech's express prior written consent.

All original content created through the Service at your request shall be your exclusive property. However, El Ruedo Tech retains a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use such content for marketing, research, development, and other business purposes, including the right to modify, reproduce, distribute, display, and perform it.

We reserves the right to display, showcase, or use for marketing purposes any work created using the Service, unless specifically agreed otherwise with the you.

We do not warrant that the Service will be uninterrupted or error-free & acknowledge that hardware, software, or other problems or damage to your systems may result in loss of data or other interruptions. In no event shall El Ruedo Tech be responsible for any loss, damage, or inconvenience suffered by you due to such interruptions or lack of availability of the Service.

You acknowledge that the Service uses artificial intelligence to generate content, and as such, the results may be unpredictable and may not meet your expectations. We make no guarantees regarding the accuracy, quality, appropriateness, or suitability of any generated content. You are solely responsible for reviewing and determining whether generated content is fit for their intended purpose.

The Service is provided on an "as is" & "as available" basis. El Ruedo Tech expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. El Ruedo Tech makes no warranty that the Service will meet your requirements or that the Service will be uninterrupted, timely, or error-free.

El Ruedo Tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use our Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein.

These Terms are governed by and construed in accordance with the laws of France.

We reserve the right to terminate or suspend your access to the Service at our sole discretion, without notice and for any reason, including but not limited to your violation of these Terms.

All purchases on Thumbzit are final. We do not offer refunds for subscriptions or additional credit purchases. This includes monthly, yearly, and one-time credit top-ups. We keep things simple and transparent with a no-refund policy. It allows us to focus fully on improving the product for active users, rather than spending time handling refund abuse or edge cases. You're always in control and subscriptions can be cancelled anytime via your customer portal, and you'll retain access to the platform and any remaining credits until the end of your billing cycle.

Your allocated credits reset on your subscription renewal date, applicable to both monthly & yearly subscriptions. Unused credits do not carry over to the next billing period.

These Terms constitute the entire agreement between you and El Ruedo Tech regarding the use of our Service, superseding any prior agreements between you and El Ruedo Tech regarding the use of our Service.
